1. About these Terms#
These Terms of Use (“Terms”) are an agreement between you and A. S. Samokysh, an individual entrepreneur registered in Ukraine (Unified State Register record No. 2 053 000 0000 000850) (“we”, “us”), for the DAR GYM app and related services (the “Service”).
By using the Service, you agree to these Terms; if you don't agree, don't use it. How we handle personal data is described in our Privacy Policy (https://dargym.app/pl/privacy).
Version: [to be filled in].
2. What DAR GYM is#
DAR GYM is a fitness and healthy-lifestyle app for adults (18+). It helps plan strength and bodyweight training, log workouts, nutrition and wellbeing, and adjust training load to the user's goals, experience and self-reported limitations. DAR GYM is not a medical device. It is not intended to diagnose, prevent, monitor, treat or alleviate any disease, injury or condition, does not replace a doctor, physiotherapist or other healthcare professional, and does not provide medical advice.
3. Training safety#
Physical exercise carries risks, including the risk of injury. You decide whether to do a workout, and you are responsible for how you do it: choose weights and pace you're confident with, watch your technique, and use equipment in good condition in a safe place.
If you have a health condition or an injury, or take medication, talk to a doctor before training. If you feel pain or discomfort during an exercise, stop the exercise. If you feel your life may be at risk, stop and call your country's emergency number. DAR GYM is not for emergencies.
Calorie, weight and training-load targets in the app are general guides: the app doesn't know everything about you.
The supplement guide contains general information with sources and the “typical dose per source”. It isn't medical advice and isn't a prescription. If you take medication, discuss supplements with your doctor.
4. Age#
The Service is only for people aged 18 or older. By confirming your age, you confirm that you are at least 18. If we learn that you are under 18, we will delete the account and its data (the app will first ask you to confirm your year of birth).
5. Your account#
You can sign in with Apple (on iPhone), Google (on Android), or email and password. Your account is personal: don't share it with others or create an account in someone else's name. Give accurate information (including age, weight and training limitations) — recommendations depend on it. Keep your password and your email, Apple or Google account secure; tell us about any unauthorized access at support@dargym.app.
The app works offline and uploads changes when you're online, so changes that haven't been uploaded may be lost if you sign out or delete the app (the app warns you about this when you sign out).
6. The AI coach#
DAR GYM includes an AI coach: you are talking to artificial intelligence (Google's Gemini model, called only by our servers), not a person.
AI can make mistakes: it may misjudge calories in a photo, misunderstand a request or give an incomplete answer. Double-check anything important and listen to how you feel. The AI never changes your data on its own: its suggestions come as cards, and you decide whether to save them.
The AI coach doesn't assess symptoms, give advice about medication or provide medical advice. For such questions the app shows a fixed message, and in urgent situations it shows your country's emergency number.
Your data is sent to Google Gemini only with your separate consent (details in the Privacy Policy). Without that consent, AI features are unavailable and your training program is built by the app's rules without AI.
If a coach reply in the chat, the “Tip of the day” or the weekly review seems harmful, false or inappropriate, tap “Report” under it. We review reports and improve our safeguards.
7. Subscription, free trial and payment#
Some features are free (including manual workout logging, the diary, charts and the exercise catalog). Full access, including AI features, comes with a DAR GYM Premium subscription — monthly or annual.
Payment through the store. When subscriptions become available, they're sold through the App Store (Apple) or Google Play (Google), not by us. Payment, taxes and refunds are governed by the terms of the store where you bought. The price and currency for your country are shown on the subscription screen before you buy.
Auto-renewal. Your subscription renews automatically until you cancel it in your store's subscription settings before the current period ends (on the App Store, at least 24 hours before). After you cancel, you keep access until the end of the period you've paid for.
Free trial. If the store offers a free trial, it's available once per store account. If you don't cancel before the trial ends (on the App Store, at least 24 hours before), it becomes a paid subscription.
Deleting your account doesn't cancel your subscription — cancel it in the store separately. “Restore purchases” in the app restores access to a subscription you've already paid for.
Right to withdraw. If your country's law gives you a right to withdraw (14 days in the EU and UK), use it through the store where you bought. These Terms don't limit your other consumer rights.
Price changes. The store notifies you of price increases for existing subscriptions and, where its rules or the law require, asks for your consent.
8. Acceptable use#
You must not:
- get around usage limits, the free trial or payment, including by using multiple accounts, modified clients or automated requests;
- try to make the AI coach break its safety rules, reveal internal instructions or access other people's data;
- use the Service for illegal, abusive or dangerous content, including encouraging self-harm or dangerous fasting;
- enter other people's personal or health-related data;
- use the Service with clients as a medical tool or present the app's suggestions as medical advice;
- decompile, modify, copy or resell the app, scrape it, or use its replies or catalog to train other AI models;
- interfere with our servers, test them for vulnerabilities without our written permission, or bypass security measures.
If you find a vulnerability, email support@dargym.app — we'll reply.
9. Your content#
Everything you add — workouts, notes, photos, messages, including dictated ones — belongs to you. You give us a non-exclusive, free licence to store, process and display this content only to provide the Service to you (including sending it to AI with your consent), for as long as your account exists and for the retention periods in the Privacy Policy. We don't sell your content or use it for advertising. Don't upload content you don't have rights to, or photos of other people without their consent.
If you send us feedback or ideas, we may use them to improve the Service without any obligation to you.
10. Our intellectual property#
The app, its design, texts, exercise catalog, training method and software belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on your devices under these Terms (and, for the App Store, Apple's Usage Rules). Exercise animations are used under licence from third parties; food product data comes from Open Food Facts under the Open Database License (ODbL); open-source components are used under their licences.
11. Changes and availability#
We keep developing the Service: adding, changing or removing features. We'll warn you in the app in advance about any significant reduction in paid features. If a change significantly reduces paid features, you can cancel your subscription; refunds for the unused period go through the store where the law requires.
AI features have usage limits — per day, week, month, trial or in total (on the free plan). We may change the limits and temporarily turn off individual AI features because of technical problems, overload or to protect users; workouts, the diary and rule-based progression keep working without AI.
We don't guarantee uninterrupted operation: there may be breaks for updates and outages at our providers (hosting, Google, Apple). The Service isn't available in every country — including where our AI providers are unavailable or sanctions apply.
12. Account deletion and termination#
You can delete your account at any time in the app (Profile → Settings → Data and consents → Delete account) or by emailing support@dargym.app; instructions are on the page https://dargym.app/pl/delete-account. Deletion erases your account and data from our servers as described in the Privacy Policy; data on your phone is removed with the app. Cancel your store subscription separately (section 7).
We may suspend or close your account if you seriously or repeatedly break these Terms or if the law requires it. Where possible, we'll warn you and explain why. Once subscriptions are available: if we close your account for a reason other than your breach, we'll refund the unused period (on Google Play ourselves; on the App Store we'll help you request it from Apple).
Sections that by their nature should survive termination continue to apply (including 9 and 13–16).
13. Warranties#
We make reasonable efforts to keep the Service working well and safely, but we provide it “as is” and “as available”. To the extent the law allows, we don't guarantee that the Service will be error-free or uninterrupted, that AI replies will be accurate, or that you'll reach a particular result (strength, weight, fitness). This section doesn't limit your mandatory consumer rights under the law of your country, including the right to digital content and services that conform to the contract.
14. Limitation of liability#
To the extent the law allows:
- we are not liable for indirect losses (lost profits, loss of data that wasn't synced, and the like) or for your own decisions based on the app's or AI's suggestions, unless the harm was caused by our fault or breach of these Terms;
- our total liability to you for all claims is limited to the greater of: the amount you paid for DAR GYM Premium in the 12 months before the event giving rise to the claim, or 50 euros.
These limits don't apply where the law of your country doesn't allow liability to be limited.
15. Changes to these Terms#
We may change these Terms — for example, when features, prices or laws change. We'll tell you about significant changes in the app at least 30 days before they take effect (or with shorter notice if the law or safety requires it); the app will ask you to confirm the new version. If you don't agree, you can delete your account and cancel your subscription before that date. Previous versions are available on request.
16. Governing law and disputes#
These Terms are governed by the laws of Ukraine, unless the mandatory laws of your country of residence provide otherwise. If you have a complaint, please contact us first at support@dargym.app — we aim to resolve it within 30 days.
17. App Store and Google Play#
If you downloaded the app from the App Store, Apple's standard Licensed Application End User License Agreement applies alongside these Terms. If you downloaded it from Google Play, purchases are also subject to the Google Play Terms of Service and Google Play refund policies. We, not Apple or Google, are responsible for the app.
18. General#
- If any provision of these Terms is found invalid, the rest remains in effect.
- If we don't enforce a right straight away, we haven't waived it.
- We may transfer our rights and obligations under these Terms to another party that will continue to provide the Service (for example, if we set up a company), and we'll tell you; this won't reduce your rights. You may not transfer your rights under these Terms without our consent.
- These Terms are available in the app's 15 languages. If translations differ, the English version prevails unless the law of your country requires otherwise.
